Terms and Conditions
This form sets out terms which ASDA Stores Ltd
("ASDA") will provide telecommunication services (the "Services")
to you. The call prices
shown in ASDA Calltime Call Prices and Notes for Customers are an integral
part of these terms and conditions and can be obtained from HERE.
The description of any service in these documents does not impose
any obligation upon ASDA to provide Services other than the ASDA Calltime
Services described below. The ASDA Calltime Services are provided
to you upon the following terms and conditions:
1. (a) For the purpose of ensuring consistency in the terms on which
the Services are provided by ASDA to its customers and subject to 1 (b),
ASDA may vary these terms by providing notice to you.
(b) ASDA may vary any charges or rates, or charge you any taxes or duties
imposed in relation to the Services at any time by notice to you. Such
notice may take effect immediately, or on the date specified in the notice. You
can request details of our prices at any time. All prices include
VAT unless otherwise stated.
(c) ASDA will charge you for the Services in accordance with relevant
terms, tariffs, rules and charges applying at the time the Services are
used.
d) Notice of all charges mentioned in (a) to (c) above will be given
by placing notices on ASDA’s website and/or leaflets and/or notices in
ASDA stores. Exceptional tariff increases in a particular territory will
be notified to you at the time you dial a number in that territory.
2. In order to provide the Services to you, ASDA may select and at any
time change any carrier or other Service provider.
3. ASDA's nominated Service provide will hold your telephone
number and credit card details (if applicable) only to the extent necessary
to enable them to provide the Services to you and as required by law.
4. Services are made available to you on condition that you do not resupply
or resell or make Services available to any person on a commercial basis,
and that you do not use, nor allow others to use, the Services for any
improper or unlawful purpose or in any manner which is offensive or unlawful.
5. ASDA will, without notice, immediately terminate any call or the provision
of Services as soon as the credit funds on your account are exhausted
by the cost of Services provided to and used by you.
6. ASDA shall not be liable to you if it is prevented, hindered or delayed
from providing the Service by any event or circumstance beyond its reasonable
control including, without limitation, the act or default of any third
party on whom ASDA is reliant to provide the Services. If the services
remain unavailable for 3 months, ASDA will refund the remaining credit
funds on your account.
7. Nothing in these terms is intended to exclude or restrict or shall
have the effect of excluding or restricting any liability on the part
of ASDA for fraud or for death or for personal injury resulting from
its negligence.
8. While ASDA will endeavour to provide Services of a reasonable quality,
via the public switched telephone and other networks. ASDA does
not guarantee the quality of the Services. ASDA does not provide
a maintenance service.
9. ASDA or its agent will charge you for all Services supplied by ASDA
to the Service number nominated by you. There is a minimum charge
per call, which is shown on the tariff displayed in-store and on our
website. Services are charged in one-second increments with partial
seconds of usage rounded up to the next full second. Call charges
are rounded up to the nearest penny.
10. Charges for prepaid Services supplied by ASDA will be deducted from
the credit balance of your deposit at the end of the call made by you
from the Service numbers nominated by you.
11. ASDA may suspend and/or disconnect your Services
at ASDA's discretion without prior notice:
(a) if you breach any of these terms and conditions;
(b) if any Service provider is unable or unwilling, or ASDA is unable,
for any reason including any act or omission of any Service provider,
to supply or provide a Service or Services;
(c) if you do not use the Services for 12 consecutive months.
(d) In the case of (b) or (c) ASDA will refund any remaining credit funds
on your account.
12. If you have an observation or complain regarding
the Services you may contact our freephone helpline on 0800 376 8785
and selecting option 0.
13. You may also refer any complaints regarding the Services to OFTEL.
14. These terms and conditions shall be governed by and interpreted in
accordance with English law, and the English courts shall have jurisdiction
to resolve any disputes between us.
15. Offer applies to UK residents only.
When you make a call from your home phone to
the countries and destinations, you will be charged at a rate of pence
per minute corresponding to the destination called. Please read
these prices in conjunction with the Notes for Customers and the Terms
and Conditions applicable to ASDA Calltime. |
